FIQ - Formula IQ Holdings LLC Affiliate Program Terms and Conditions
Participation in the Formula IQ Holdings LLC Affiliate Program is subject to the terms and conditions set forth in this section, in addition to all other provisions contained within these Terms of Use and Conditions of Sale. By applying for or participating in the Affiliate Program, the affiliate acknowledges and agrees to be bound by these terms.
Eligibility and Approval
Formula IQ Holdings LLC reserves the right, in its sole discretion, to approve or deny any application to participate in the Affiliate Program for any reason. Applicants must provide complete and accurate information during the application process. As a condition of approval, all applicants must provide active social media accounts, websites, or other promotional platforms, including all associated usernames or handles, that will be used to promote Formula IQ products.
Affiliates are required to maintain active and publicly accessible promotional channels that align with the brand, values, and product positioning of Formula IQ Holdings LLC. The Company reserves the right to request updated information regarding promotional channels at any time. Failure to provide accurate or updated information may result in suspension or termination of the affiliate account.
Commission Structure
Approved affiliates may earn commissions on qualifying purchases made through their assigned affiliate tracking links. Commissions are calculated based on the net sales amount, excluding shipping charges, taxes, refunds, chargebacks, discounts, and any fraudulent or invalid transactions. Commissions are earned only on completed and verified transactions that are properly tracked through the affiliate system.
Formula IQ Holdings LLC reserves the right to modify commission rates, commission structures, or promotional incentives at any time without prior notice.
Minimum Payout Threshold
Affiliate commissions will not be paid until a minimum of one hundred fifty dollars ($150) in earned commissions has been accumulated from verified and tracked orders. Commissions that do not meet the minimum payout threshold will remain in the affiliate account until the threshold is satisfied.
Formula IQ Holdings LLC reserves the right to withhold payment of commissions for orders that are returned, refunded, cancelled, fraudulent, or otherwise determined to be invalid.
Ongoing Activity Requirement
Following the initial ninety (90) days of participation in the Affiliate Program, affiliates must maintain a minimum of one hundred fifty dollars ($150) in earned commissions per calendar month in order to remain active in the program. Affiliates who fail to meet this monthly performance requirement after the initial ninety (90) day period may be deemed inactive and may be removed from the Affiliate Program at the sole discretion of Formula IQ Holdings LLC.
Formula IQ Holdings LLC reserves the right to terminate an affiliate account and discontinue participation in the program without payment of outstanding commissions if the minimum performance requirements are not maintained.
Termination
Formula IQ Holdings LLC reserves the right to suspend or terminate any affiliate account at any time, with or without notice, and for any reason, in its sole discretion. The Company is not required to provide cause for termination.
Termination may occur if the Company determines that the affiliate no longer aligns with the brand, mission, values, or product positioning of Formula IQ Holdings LLC, or if the affiliate engages in conduct that may harm the reputation of the Company or its products.
Upon termination of an affiliate account, all affiliate privileges may be revoked immediately, including access to the affiliate platform and the use of affiliate links. Any unpaid commissions may be forfeited at the sole discretion of Formula IQ Holdings LLC.
Prohibited Conduct
Affiliates agree not to engage in any conduct that violates applicable laws or regulations or that is inconsistent with the standards of Formula IQ Holdings LLC. Prohibited conduct includes, but is not limited to, making false or misleading statements about Formula IQ products, making medical or disease treatment claims, engaging in spam or unsolicited communications, using unauthorized discounts or promotional offers, misrepresenting affiliation with the Company, or purchasing products through their own affiliate links for the purpose of generating commissions.
Formula IQ Holdings LLC reserves the right to reverse commissions generated through prohibited or unauthorized activities.
Brand Use and Compliance
Affiliates may use the trademarks, logos, images, and marketing materials of Formula IQ Holdings LLC only as expressly authorized by the Company. All promotional content must accurately represent the Company’s products and comply with all applicable laws, regulations, and advertising standards, including Federal Trade Commission disclosure requirements.
Formula IQ Holdings LLC reserves the right to require modification or removal of any content that does not meet compliance or brand standards.
Independent Contractor Status
Affiliates are independent contractors and are not employees, partners, joint venturers, or agents of Formula IQ Holdings LLC. Participation in the Affiliate Program does not create any employment, partnership, or agency relationship between the parties. Affiliates have no authority to bind or represent the Company in any manner.
Affiliates are solely responsible for all taxes, reporting obligations, and expenses arising from participation in the Affiliate Program.
Modification of Affiliate Program
Formula IQ Holdings LLC reserves the right to modify, suspend, or discontinue the Affiliate Program, or any portion thereof, at any time and without prior notice. Continued participation in the Affiliate Program following any modification constitutes acceptance of the revised terms.
Governing Law
These Affiliate Program Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles, and shall be incorporated into and interpreted consistently with the full Terms of Use and Conditions of Sale of Formula IQ Holdings LLC.
